Please read these Terms and Conditions carefully before using the Kidy platform. By accessing or using the Service, you confirm that you have read, understood, and agree to these terms.

1. Definitions

  • "Platform" or "Service" – the Kidy SaaS platform, including the website (kidy.pro), mobile application, and all associated services.
  • "Kidy", "we", "our", "us" – the operator of the Kidy platform.
  • "Customer" or "Institution" – the educational institution that registers for and uses the Service.
  • "User" – any person who accesses the platform (administrators, educators, parents).
  • "Content" – any data, information, or materials uploaded to the platform by Users.
  • "Subscription" – the service plan contracted by the Customer.

2. Acceptance of Terms

By creating an account or using the Kidy platform, you accept these Terms and Conditions, the Privacy Policy, and the Cookie Policy. If you do not agree to these terms, do not use the Service.

We reserve the right to modify these terms at any time. Changes will be communicated via email or in-platform notification at least 30 days before taking effect.

3. Description of Service

Kidy is a multi-tenant SaaS platform designed for educational institutions, offering:

  • Student/child and class/group management
  • Attendance tracking
  • Communication between institution and parents
  • Staff administration
  • Billing and payment management
  • Reporting and analytics

Available features may vary depending on the selected subscription plan.

4. Free Trial

Kidy offers a free trial period of 30 days from the date of registration. During the trial period, you have access to all platform features.

Upon expiration of the trial period, if you have not activated a paid subscription, access to the platform will be suspended. Your data will be retained for a 30-day grace period, after which it will be permanently deleted.

No payment information is required to start the free trial.

5. Subscriptions and Payments

a) Subscription plans

The Service is offered on a monthly or annual subscription basis. Prices and features included in each plan are displayed on our website and may be modified with 30 days' prior notice.

b) Billing

Invoices are issued at the beginning of each billing period. Payment is made by credit card, securely processed through Stripe.

c) Refunds

Annual subscriptions may be refunded within the first 14 days of activation. Monthly subscriptions are non-refundable. The free trial period involves no payment obligation.

6. User Account

You are responsible for:

  • Maintaining the confidentiality of your access credentials (email and password)
  • All activities conducted through your account
  • Immediately notifying us of any unauthorized use of your account

Do not share your access credentials with unauthorized persons. Kidy will not be liable for losses resulting from unauthorized use of your account.

7. Acceptable Use

You agree to use the platform responsibly and lawfully. It is prohibited to:

  • Use the Service for illegal or unauthorized purposes
  • Upload content that infringes on third-party rights or applicable law
  • Attempt to gain unauthorized access to systems, networks, or other users' data
  • Transmit viruses, malware, or other harmful code
  • Intentionally overload the platform infrastructure
  • Use the platform for harassment, discrimination, or any abusive behavior
  • Reproduce, duplicate, or resell the Service without authorization
  • Systematically extract data from the platform (scraping)

Violation of these rules may result in suspension or termination of your account without prior notice.

8. Data Ownership

Your data belongs to you. Kidy does not claim any ownership rights over data entered by Customers and Users on the platform.

  • The Customer remains the owner and controller of data entered on the platform
  • Kidy acts as a data processor in accordance with GDPR terms
  • Upon subscription termination, you may request data export in a standard format (CSV/JSON) within 30 days
  • After the 30-day grace period, data is permanently deleted from our servers

9. Intellectual Property

The Kidy platform, including its design, source code, logos, brand, and documentation, is protected by copyright and intellectual property rights. All rights reserved.

The license to use the Service is:

  • Non-exclusive and non-transferable
  • Limited to the duration of the active subscription
  • Intended solely for the purpose for which the Service was contracted

You may not copy, modify, distribute, sell, or license Kidy software or any of its components.

10. Service Availability

We make reasonable efforts to maintain platform availability. However, Kidy does not guarantee uninterrupted or error-free operation.

  • Planned maintenance operations will be communicated at least 48 hours in advance
  • We are not responsible for unavailability caused by external factors (internet providers, cyber attacks, force majeure)

11. Limitation of Liability

To the maximum extent permitted by law:

  • Kidy is provided "as is" and "as available"
  • We make no express or implied warranties regarding fitness for a particular purpose
  • Kidy will not be liable for indirect, incidental, special, or consequential damages
  • Kidy's total liability will not exceed the subscription amount paid in the last 12 months
  • We are not responsible for data loss caused by User actions

12. Termination

a) Termination by Customer

You may cancel your subscription at any time from account settings. Cancellation takes effect at the end of the current billing period.

b) Termination by Kidy

We reserve the right to suspend or terminate access in the following situations:

  • Violation of these Terms and Conditions
  • Non-payment of subscription after the grace period
  • Fraudulent or illegal activity
  • Use that endangers platform security or other users

In case of termination, you will be notified and will have 30 days to export your data.

13. Indemnification

You agree to indemnify and hold harmless Kidy from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Romania.

Any dispute shall first be resolved amicably. If an amicable resolution is not reached within 30 days, disputes shall be submitted to the competent courts in Romania.

For EU consumers: you have the right to use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

15. Final Provisions

  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in effect
  • Failure to exercise a right does not constitute a waiver of that right
  • These Terms constitute the entire agreement between the parties regarding use of the Service
